The Fit Cartel — Terms of Service

These Terms of Service govern purchases made from The Fit Cartel, operated by House of Koka (“The Fit Cartel”, “we”, “us” or “our”). By using our online store or placing an order, you agree to these Terms, subject to your rights under South African law.
1. General Information
The Fit Cartel is a South African online retailer specialising in streetwear, sneakers and related fashion products.
Certain products sold by The Fit Cartel are sourced internationally and imported into South Africa after an order is placed.
These Terms should be read together with our Refund Policy, Shipping Policy and Privacy Policy.
Nothing in these Terms excludes or limits any rights granted to consumers under the Consumer Protection Act 68 of 2008 (“CPA”) or other applicable South African law.
2. Product Availability
All products are subject to supplier and stock availability.
Because certain products are sourced internationally, availability may occasionally change after an order has been placed. If we are unable to fulfil an order, we will contact the customer and provide an appropriate refund or alternative where agreed.
We make reasonable efforts to ensure product descriptions, sizes, colours and images are accurate. Colours may vary slightly depending on the customer's screen or device.
3. Pricing & Payment
All prices are displayed in South African Rand (ZAR).
Payments are securely processed through FNB's payment gateway/card-processing services. Transactions may be subject to authorisation by FNB, the customer's card issuer and applicable fraud-prevention measures.
Where applicable, the price charged by The Fit Cartel takes into account the costs associated with sourcing and importing products into South Africa.
4. Order Confirmation & Shipping
After placing an order, customers will receive confirmation that their order has been received.
Because products may be sourced internationally, customers should generally allow approximately 1–2 weeks for sourcing, international transportation, customs clearance and arrival in South Africa.
Once the order has arrived locally and is ready for final delivery, it is dispatched through Bob Go, which allocates the parcel to an appropriate South African courier.
Local delivery generally takes an additional 1–3 business days after dispatch.
These timeframes are estimates and may be affected by supplier delays, international transportation, customs processing, public holidays, courier delays or circumstances outside our reasonable control.

5. Returns & Exchanges
Eligible returns and exchanges may be requested within the period stated in our Refund Policy.
Returned items must generally be unused, unworn, undamaged and in their original condition, with original packaging and tags.
Customers are responsible for return shipping on eligible change-of-mind returns.
As explained in our Refund Policy, a 20% handling and administration fee may apply to eligible discretionary refunds, including to help recover reasonable sourcing, handling, administration and import-related costs already incurred.
The 20% fee does not apply where doing so would conflict with rights or remedies available under South African law, including qualifying defective or incorrectly supplied goods.

6. Customs Duties & Taxes
Certain products sold by The Fit Cartel are imported into South Africa.
The Fit Cartel covers the applicable import duties and customs charges associated with bringing these products into South Africa on the customer's behalf. Customers will therefore not ordinarily be required to separately pay import duties to receive their order through our normal South African delivery process.
Import and customs clearance times can vary and may affect the estimated 1–2 week sourcing and import timeframe.
7. Account & Security
Customers are responsible for maintaining the confidentiality of their account information and for ensuring that information submitted when ordering is accurate.
Please notify The Fit Cartel promptly if you believe your account has been accessed without authorisation.
8. Intellectual Property
The Fit Cartel name, branding, website design, original photographs, graphics and other original content belonging to us may not be copied or commercially used without permission.
Third-party brand names, trademarks and product imagery remain the property of their respective owners.
9. Limitation of Liability
To the fullest extent permitted by South African law, The Fit Cartel will not be responsible for indirect losses or delays caused by circumstances reasonably outside our control, including international transportation, customs processing or courier disruptions.
Nothing in these Terms excludes or restricts liability or consumer remedies that cannot legally be excluded under the CPA or other applicable South African law.
10. Privacy Policy
The collection and use of customers' personal information are governed by our separate Privacy Policy.
11. Modifications
We may update these Terms when our business practices, services or legal obligations change. The latest version will be published on our website with an updated effective date.
Changes will not unlawfully remove rights relating to transactions already completed.
12. Governing Law
These Terms and purchases made from The Fit Cartel are governed exclusively by the laws of the Republic of South Africa.
Any dispute will be handled in accordance with applicable South African law and, where court proceedings are necessary, by a court of competent jurisdiction in South Africa.
Nothing in these Terms overrides a consumer's rights under the Consumer Protection Act 68 of 2008 or other applicable South African legislation.
